terms of sale
These terms govern every sale made through ouestactive.online. They are between you, as a consumer, and OUEST ACTIVE, whose full statutory identification is on the mentions légales page. Placing an order means you accept them.
They are written to be read. Where a right is yours by law we say so and we do not try to reduce it — a clause that tried to would be void anyway.

01who sells, and to whom
The seller is OUEST ACTIVE, trading online as Ouestrail, registered office 6 Place du Vert Buisson, 35170 Bruz, France. Customer service: support@ouestactive.online, +33 6 37 36 59 74, Monday to Friday, 09:00–17:00 (Europe/Paris).
We sell to consumers acting outside any commercial activity, aged 18 or over, for delivery to the destinations listed on the delivery page. We do not sell for resale, and we do not open trade accounts.
- There is no membership, no subscription and no recurring payment of any kind on this site. Every purchase is a one-off.
- No account is required to order. We ask only for what the carrier and the invoice need.
02the products, and what they are not
We sell 43 items of outdoor and technical clothing: base layers, mid layers, shells, trousers, non-protective accessories and two sets. Each product page states the fibre composition, the care instructions, the country of make, the fabric weight, the measured dimensions with a ±1 cm tolerance, and a suitability grade for hiking, cycling and commuting with the reason for each grade.
Two limits apply to every item and are repeated on every relevant page:
- Our shells are water-repellent, not rain barriers. No hydrostatic test figure is published for any fabric, and in persistent rain water reaches the layer underneath. See performance and its limits.
- Nothing sold here is personal protective equipment. Reflective trim is decorative; it conforms to no high-visibility standard and is not certified safety equipment. We sell no helmets and no protective gear of any kind.
Photographs are as faithful as photography allows; a screen renders colour differently from a room, and that difference is not a defect. Stock is finite: if an item becomes unavailable after you order it, we tell you promptly and refund that line in full.
03prices
- currency
- EUR (euro) — every price on the site is in euro
- tax
- all prices are shown inclusive of VAT (TTC) at the applicable French rate
- range
- €19 to €249
- delivery
- charged separately and shown before you commit — see delivery
- validity
- the price that applies is the one displayed when you place the order
We may change prices at any time; a change never affects an order already placed. An obvious pricing error does not oblige us to sell at that price — if one occurs we contact you first and you may cancel at no cost.
Promotions, where they run, are described in full on the promotion terms page, including the reference price any advertised saving is calculated against. We run no countdowns and no artificial deadlines.
04how an order is made
- 01You add items to the basket, choosing a size. Adding an item increments the basket count; nothing opens over the page.
- 02The basket shows each line, the goods total including VAT, the delivery charge and the total to pay, plus any advisory that applies to what is in it.
- 03At checkout you give the delivery and contact details we need, and you confirm two things separately: that we may process those details, and that you accept these terms and have read the right of withdrawal.
- 04You are then taken to the payment step. Nothing is charged before that step is completed.
- 05Once payment is authorised we send an email confirming the order. That email is the point at which the contract is formed.
Before the payment step you can go back and change anything. The order summary shown at checkout is the record of what you are agreeing to buy.
We may refuse an order where there is a manifest error, a suspicion of fraud, a dispute outstanding on a previous order, or a delivery address we cannot serve. If we do, we tell you why and nothing is charged.
05payment
Payment is taken at the payment step, in EUR (euro), for the full amount including VAT and delivery. The payment methods available are those configured for this shop by its operator; the card schemes accepted are shown at checkout and on the payment and site security page.
- Visa
- Mastercard
- Cartes Bancaires (CB)
- American Express
- Card details are entered on the secure payment page and are never transmitted to, processed by or stored on this site.
- The whole site is served over HTTPS.
- Your order is prepared once payment is authorised. If authorisation fails, the order does not proceed and nothing is owed.
- An invoice showing the VAT is issued with the order and sent by email.
06delivery
Dispatch is within two working days of payment being authorised. Carriers, times, rates and destinations are set out in full on the delivery page. Free delivery applies from €120 of goods.
Risk in the goods passes to you when you, or somebody you have nominated, takes physical possession of them. If a parcel arrives damaged, note it with the carrier where you can and tell us — that is our problem to solve, not yours.
If we have not delivered by the date indicated, and the delay is not attributable to you, you may instruct us to deliver within a further reasonable period and, if we still do not, cancel the order and be reimbursed in full.
07right of withdrawal
You have 14 days from receipt to withdraw from the contract without giving any reason. The full procedure, the standard withdrawal form and the deadlines for reimbursement are on the right of withdrawal page.
The one exception. Sealed items that are not suitable for return for reasons of hygiene lose the right of withdrawal once the seal has been broken. On this site that applies to the merino boxer, the synthetic base bottom and the merino sock pack. Each of those product pages says so before you buy.
08legal guarantees
Two separate legal guarantees apply to everything we sell, independently of each other and at no cost to you: the legal guarantee of conformity and the guarantee against hidden defects. They have different conditions and different deadlines, and they are set out one after the other on the guarantees page.
Normal wear is not a defect. A water-repellent finish wearing out after the number of washes we publish is normal wear, not non-conformity — which is exactly why we publish that number.
09producer responsibility, sorting and recycling
Textiles placed on the French market fall under an extended producer responsibility scheme, and since 1 February 2023 they must carry the Triman marking and sorting information.
- scheme identifier (IDU)
- [to be completed by the operator before launch]
- marking
- Triman, with sorting information, on the product page and on the sewn-in label
- what to do with a worn-out garment
- see sorting and recycling
Each product page lists the environmental characteristics of that item — whether it is a single fibre family, whether panels are stitched rather than bonded, whether trims can be removed.
10personal data
What we collect, why, how long we keep it and how you exercise your rights — including your right to lodge a complaint with the CNIL — is set out in the personal data notice and, for cookies, on the cookies page.
11complaints, mediation and applicable law
Write to support@ouestactive.online first — most things are settled that way within a day. If we cannot agree, you may refer the matter free of charge to a consumer mediator; who, and how, is on the mediation page, together with the European online dispute resolution platform.
These terms are governed by French law. Nothing in them removes your right, as a consumer, to bring proceedings in the courts of the place where you live.
12force majeure, proof and changes
- Neither party is liable for failure caused by an event outside its control. If such an event lasts more than 30 days, either of us may cancel the affected order and any sum paid is reimbursed.
- Our records of the order and its confirmation are kept as proof of the transaction, for the periods stated in the personal data notice.
- We may change these terms. The version that applies to your order is the one published when you placed it, and this page carries its last-updated date.
- If any clause here turns out to be unenforceable, the rest continues to apply.
